Refund and return policy

These general terms and conditions (hereinafter "Terms") apply to all product supplies made by Made Consulting S.r.l. (hereinafter "Seller"). By submitting an order to Made Consulting S.r.l., the Buyer (hereinafter "Buyer") fully accepts these Terms to the exclusion of all other terms, conditions, warranties, or representations.

User Account and Content Restrictions
Users are prohibited from posting or transmitting through the piantami.com website or service any illegal, harmful, threatening, harassing, defamatory, vulgar, obscene, sexually explicit, discriminatory, or otherwise objectionable material, including but not limited to any material that encourages conduct constituting a criminal offense, civil liability, or violation of local, state, national, or international laws.

II. Nature of the Service
Made Consulting, through piantami.com, supplies plantable paper embedded with live seeds.

III. Contract Formation and Subject Matter
Any agreement between the Seller and the Buyer for the sale of products shall be valid and binding only upon written confirmation by the Seller, unless the Seller begins execution without written approval—in which case the Seller will immediately notify the Buyer. Definition of "Products": Raw materials, components, and finished goods supplied by the Seller under these Terms, as specified in the accepted order or any duly agreed amendments (hereinafter the "Contract"). The Contract cannot be canceled, extended, amended, or modified without the Seller’s written consent. These Terms supersede any other terms referenced by the Buyer, including Incoterms or similar provisions. Each delivery request must be submitted as a separate Order, specifying product type, quantity, delivery address, technical specifications ("Buyer’s Specifications"), and any additional Seller requirements.

IV. Product Supply
The Seller will deliver Products per the Order Confirmation. The Seller is not liable for the Buyer’s use of Products based on Buyer’s Specifications, which are deemed indicative only. The Seller reserves the right to modify technical/descriptive Product Features for safety or performance improvements, provided such changes do not substantially alter the Product’s quality or function.

V. PRICES AND PAYMENTS
Prices are as stated in the Order Confirmation, subject to revision for material/energy cost increases ≥5%. The Buyer may terminate the Contract within 5 days of price adjustment notice. Payment terms are essential. Late payments entitle the Seller to: Charge default interest (per Italian Legislative Decree 231/2002), Suspend deliveries, Terminate the Contract, Reclaim unpaid Products (per Clause IX). Prices are ex-VAT; invoices must be paid in full without deduction.

VI. DELIVERY
Delivery occurs at the location specified in the Order Confirmation (or Seller’s warehouse if unspecified). Delivery dates are approximate; delays do not entitle the Buyer to terminate the Contract. The Seller may make partial deliveries. Force majeure events (e.g., strikes, natural disasters) extend delivery timelines.

VII. NOTIFICATION OF LOSS OR NON-DELIVERY
The Buyer must notify the Seller in writing within 8 days of delivery for shortages, damages, defects, or non-delivery. Failure to report voids all claims.

VIII. INSURANCE
The Buyer must insure Products against damage, loss, or theft from delivery until full payment. Proof of insurance ("Policy") may be requested.

IX. RETENTION OF TITLE
Ownership of Products remains with the Seller until full payment. The Buyer must store Products separately, identify them as Seller’s property, and insure against damage. The Seller may reclaim unpaid Products without judicial order.

X. TERMINATION CLAUSE
The Seller may terminate the Contract (per Art. 1456 Italian Civil Code) if the Buyer defaults on payments for more than 5 days. The Buyer must: Return Products at their expense, Pay a 15% penalty on the purchase price (plus damages). Termination also applies if the Buyer enters liquidation or bankruptcy proceedings.

XI. LIMITATION OF LIABILITY
The Seller guarantees only Product conformity to Order specifications. Liability for manufacturing defects expires 180 days post-delivery, excluding: Buyer’s misuse or unauthorized modifications, Non-Seller-produced components. Liability for death/personal injury caused by Seller negligence is not excluded.

XII. SAFETY PRECAUTIONS
The Buyer must comply with all Seller-provided instructions, warnings, and technical documentation (e.g., health/safety guidelines).

XIV. GOVERNING LAW AND JURISDICTION
These Terms are governed by Italian law. Disputes fall under the exclusive jurisdiction of Benevento Court. Continued use of piantami.com constitutes acceptance of updated Terms.
